Must a seller provide a buyer with a written seller property disclosure statement?
A seller is not required in the state of Florida to provide a buyer with a written disclosure statement. However, it’s often done because the contract provides that if certain things are disclosed, and the buyer has the opportunity to review the property, then later in the closing, there can be no objections made or no demands made for a particular item.
What you are required to disclose, whether it’s in writing or not, is any known material facts that affect the value of the property, and the written statement is often the best way to do that because it alleviates you from dealing with issues down the road.
