What is a durable power of attorney?
A durable power of attorney is a document that allows you to delegate control over your finances, your property, while you’re alive. You give that power to a third party, and if you lose capacity, or become incapacitated, the power is remaining durable, which means it continues even after you aren’t able to sign things, for instance. It’s also a least restrictive alternative to guardianship. A guardianship in Florida is extremely expensive. A durable power of attorney is an alternative to guardianship, allowing you to delegate power that would otherwise be given by a courthouse to a guardian.
